Acceptance of Terms

By accessing or using the Cascade Mail email service platform ("Service") operated by Salloq Software, LLC ("we," "us," or "Cascade Mail"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

If you do not agree with any part of these Terms, you must not use the Service.

Service Description

Cascade Mail is an email service provider (ESP) that provides tools and infrastructure for sending transactional and marketing email communications. The Service includes SMTP relay, API-based sending, email campaign management, analytics and reporting, bounce and complaint processing, list management, and related features.

We reserve the right to modify, enhance, or discontinue features of the Service at any time, with reasonable notice for material changes.

Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Accounts are non-transferable. You may not share account credentials with third parties. We reserve the right to refuse registration or cancel accounts at our discretion if we believe Terms are being violated.

Acceptable Use Policy

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including but not limited to the CAN-SPAM Act, GDPR, CCPA, CASL, and any other applicable anti-spam and data protection regulations.

Zero Tolerance for Spam: Cascade Mail maintains a strict anti-spam policy. Sending unsolicited bulk email, using purchased or scraped lists, or any form of spam will result in immediate account suspension and potential termination.

You must maintain valid opt-in consent for all recipients on your mailing lists. You must honor all unsubscribe requests within 24 hours. You must include a valid physical mailing address in all commercial email. You must include a clear and functional unsubscribe mechanism in every marketing message. You must accurately identify yourself as the sender and not use misleading header information or deceptive subject lines.

Prohibited Content

The following types of content are strictly prohibited from being sent through the Service:

Sending Practices

You agree to follow email sending best practices, including warming up new IP addresses and sending domains gradually, maintaining clean and up-to-date subscriber lists, promptly processing bounces and removing invalid addresses, monitoring and maintaining acceptable complaint rates (below 0.1%), segmenting lists and sending relevant content to engaged subscribers, and authenticating all sending domains with SPF, DKIM, and DMARC records.

We reserve the right to throttle or temporarily suspend sending if we detect practices that may negatively impact deliverability or our shared infrastructure.

IP & Reputation Management

Cascade Mail manages shared and dedicated IP addresses for email delivery. Your sending reputation directly impacts deliverability. We monitor sending patterns and engagement metrics across all accounts. If your sending practices result in elevated bounce rates, spam complaints, or blocklist listings, we may throttle your sending, move you to a restricted IP pool, require corrective action before resuming full sending, or suspend your account.

Dedicated IP customers are solely responsible for the reputation of their assigned IP addresses.

Data Ownership

You retain all ownership rights to your data, including subscriber lists, email content, and campaign data. We claim no ownership over your content. We process your data solely to provide the Service as described in our Privacy Policy.

You may export your data at any time through the Service interface or API. Upon account termination, your data will be available for export for 30 days, after which it will be permanently deleted.

Payment & Billing

Fees for the Service are based on the pricing plan selected at registration or as subsequently modified by mutual agreement. All fees are quoted in U.S. dollars unless otherwise specified. Payment is due in advance on a monthly or annual basis depending on your plan. Overages beyond plan limits will be billed at the per-unit rate specified in your plan.

We reserve the right to modify pricing with 30 days' written notice. Failure to pay within 15 days of the due date may result in service suspension. All fees are non-refundable except as required by law.

Service Level Agreement

Cascade Mail targets 99.9% uptime for the Service, measured monthly, excluding scheduled maintenance windows. Scheduled maintenance will be announced at least 48 hours in advance when possible. In the event of downtime exceeding the SLA target, eligible customers may request service credits as follows: 99.0% – 99.9% uptime provides a 5% credit, 95.0% – 99.0% uptime provides a 15% credit, and below 95.0% uptime provides a 30% credit. Credits must be requested within 30 days of the incident and are applied to future invoices only.

Suspension & Termination

We may suspend or terminate your account immediately if you violate the Acceptable Use Policy or send spam, fail to pay fees when due, engage in activity that threatens the integrity of our infrastructure, are subject to valid legal or regulatory action, or exceed reasonable usage patterns that impact other customers.

You may terminate your account at any time by providing written notice. Upon termination, you remain responsible for all fees incurred through the termination date. We will make your data available for export for 30 days following termination.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASCADE MAIL AND SALLOQ SOFTWARE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE FEES PAID BY YOU DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Indemnification

You agree to indemnify, defend, and hold harmless Salloq Software, LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, the content of emails you send through the Service, or your violation of any applicable law or regulation.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Sheridan County, Wyoming.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice within the Service at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must discontinue use of the Service.
